1. Introduction
Welcome to CommonInsightCenter ("we," "us," or "our"). The following Terms and Conditions ("Terms") dictate your engagement with our yacht charter services and our website hosted at commoninsightcenter.sbs (hereafter referred to as the "Service"), which is managed by CommonInsightCenter.
By reserving a charter or using our Service, you consent to abide by these Terms. Should you not agree with any section of the terms here, you must refrain from using the Service.
2. Service Overview
At CommonInsightCenter, we offer an array of premium yacht charter services, which include:
- Yacht rentals for the day
- Cruises at sunset
- Company retreats
- Events exclusive to your party
- Multiday yacht charters
We provide services based on their current availability and subject to prevailing weather conditions. Our services may be updated or terminated at our discretion and without prior notice.
3. Booking and Reservations
3.1 Booking Process
For booking a charter, it's necessary for you to:
- Be 18 years of age or older
- Provide details that are accurate and complete
- Submit the necessary deposit as indicated in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Your reservation is considered confirmed once we have received the payment and provided you with written confirmation. We reserve the right to decline services to any individual based on our judgment.
3.3 Availability
All charters rely on the availability of vessels and appropriate weather conditions. We will put forth reasonable efforts to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All prices are presented in € and taxes included unless mentioned otherwise. Note that prices may change without prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the total cost for the charter, due at the time of booking
- Remainder: To be paid 48 hours before the charter departs
- Additional fees (if applicable): To be settled after the charter concludes
4.3 Payment Methods
We accept most major credit cards, bank wires, and certified cheques. Our payment processing is done using secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full reimbursement minus processing expenses
- Between 24 and 72 hours prior to departure: Refund of 50%
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
In the case that weather is deemed hazardous by our captain, we will propose to:
- Change the date of your charter to another suitable day at no extra charge
- Provide a complete refund if an alternative date cannot be arranged
5.3 Mechanical Issues
If there are mechanical problems with the assigned vessel, we'll try to arrange for an appropriate substitute. If this is not possible, a complete refund will be offered.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must:
- Adhere to all instructions from the crew
- Use provided safety gear as necessary
- Disclose medical conditions that could affect their safety
- Stay within designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Excessive amounts of beverages (surpassing reasonable personal consumption)
- Pets (exceptions can be made if pre-approved)
6.3 Conduct
Passengers are expected to behave in a courteous and respectful manner. In the event that a passenger's conduct endangers safety or hinders the experience for others, we reserve the right to end the charter prematurely without offering a refund.
7. Liability and Insurance
7.1 Our Liability
We restrict our liability to the amount paid for the charter. We are not responsible for:
- Bodily harm arising from passenger negligence
- Property loss or damage
- Secondary, incidental, or punitive damages
- Delays due to weather or situations out of our control
7.2 Insurance Coverage
We maintain expansive marine insurance that covers our vessels and operations. It is the responsibility of the passengers to secure their own travel and personal insurance.
7.3 Assumption of Risk
By taking part in our charter services, you accept the intrinsic risks involved in maritime activities and you assume accountability for your safety and welfare.
8. Modifications and Itinerary Changes
We retain the right to adjust itineraries, paths, or schedules in light of weather, safety concerns, or operational demands. We will make every attempt to ensure alternatives of similar quality.
9. Force Majeure
We will not be accountable for hold-ups, changes, or cancellations engendered by forces outside of our control, which include, but are not confined to:
- Extreme weather phenomena
- Catastrophic natural events
- Legal regulations
- Port shutdowns
- Technical malfunctions
10. Privacy and Data Protection
Your sensitive data will be managed in line with our Privacy Policy. Using our services indicates your consent to the accumulation and employment of your information as delineated in our Privacy Policy.
11. Intellectual Property
All content on our website, such as text, images, logos, and visuals, is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative content is not permitted without our explicit written consent.
12. Governing Law
These Terms are regulated by the laws of Spain. Any controversies will be settled in the courts with jurisdiction in Barcelona, Spain.
13. Changes to Terms
We reserve the entitlement to revise these Terms at any time. Updated Terms will be displayed on our website with the revised date of issue. Continued engagement with our services implies acceptance of the amended terms.
